Defective Product Lawyer
Every day consumers are seriously injured or get fatal injuries by poorly designed or carelessly manufactured defective products throughout USA. A product that is labeled as a defective could be unreasonably dangerous for consumers when used. Defective products laws are governed by product liability laws, which provide consumers the right to ask for compensation for injury or property damage resulting from that defective product. We have exceptional experience in representing persons who are injured by using defective products such as ladder or other products in different areas of USA.
As Defective Product Attorneys
Our clients were using this defective product ‘ladder’ in an appropriate manner when the ladder collapsed without warning.
The use of the XTend & Climb Ladder model 770 telescoping ladder has been associated with many serious injuries due to its uncommanded collapse during consumer use. The allegedly faulty locking mechanism, lack of adequate warnings and lack of clear indications of locking mode have been criticized in consumer reports. We have several clients who were seriously and permanently injured from the collapse of this ladder when the locking mechanism failed to function as designed.
Unfortunately, Core Distribution, the maker of the ladder, has not recalled the allegedly faulty model, even though they have made subsequent modifications on replacement model that address many of the dangers posed by the XTend & Climb Ladder model 770. The ladder is silver and black, and the subsequent model is yellow and silver.
The XTend & Climb Ladder model 770 telescoping ladder is designed to be portable and easy to use. It works by being compact, about two or three feet tall, and then it extends to the length of a regular ladder. Thus there are two locking mechanisms for each step, so that as you extend it, each step locks into place. There are multiple failure modes possible including steps not fully locking into place, lack of a reasonable positive locking mechanism, lack of adequate warnings, and lack of sufficient visual and auditory cues that would give a user a reasonable basis for determining that the locks had fully engaged.
